Agreement Notice: By purchasing any services, booking a session, or making a payment to Simmonds Capture Co. (accessible via simmondscaptureco.co.uk), you acknowledge that you have read, understood, and agreed to these Terms and Conditions in their entirety.
Full Payment Upfront: All bookings require 100% full payment upfront at the time of booking to secure your date and time. Dates and time slots are not held until payment has been completed in full.
Rescheduling over Refunds: Simmonds Capture Co. operates on a strict re-book and re-shoot policy. If a cancellation or postponement is necessary by either party (including due to adverse weather or unforeseen circumstances), your payment will be transferred directly to a rescheduled date.
Cancellation & Refund Exceptions: Direct refunds will only be issued if a mutually agreeable re-shoot date cannot be found, or if Simmonds Capture Co. is unable to fulfill the service. Cancellations made by the Client with less than 72 hours' notice prior to the scheduled shoot time—where no re-booking takes place—will result in the total forfeiture of the payment.
Simmonds Capture Co. will make reasonable efforts to deliver final edited media within the estimated timeframe communicated for your specific package (typically standard delivery times range between 14 to 21 business days).
Rush delivery may be available upon request for an additional fee.
Final files are delivered digitally via an online gallery or download link. It is the Client’s responsibility to download and back up their files within the specified download window.
Standard bookings include one round of reasonable, minor revisions (e.g., color adjustment or minor cropping).
Further changes, extensive retouching, or re-editing requested after final delivery will be billed at an hourly or per-item rate.
Simmonds Capture Co.’s editing style is consistent and professional; requests to completely alter the style, mood, or color grading of delivered media will be declined or charged as custom design work.
Personal Use: The Client is granted a non-exclusive, non-transferable license to share delivered images and videos on personal social media platforms.
Tagging Requirement: When sharing media on social media platforms, the Client agrees to credit Simmonds Capture Co. by tagging the official handle or linking directly to simmondscaptureco.co.uk.
Restrictions: The Client shall not apply heavy filters, crop significantly, or alter the work in any way that distorts the integrity, quality, or professional reputation of Simmonds Capture Co. Commercial use is strictly prohibited unless a commercial license has been purchased.
Simmonds Capture Co. retains full copyright ownership of all captured media (photographs, video footage, and raw files) globally and in perpetuity.
The Client grants Simmonds Capture Co. the right to use and publish media captured during the session for portfolio, website, social media, and promotional marketing purposes, unless the Client explicitly opts out in writing prior to the shoot date.
Location Responsibility: Since shoots take place at external or public locations, the Client is responsible for securing any necessary permissions, permits, or access passes required for that specific location.
Right to Refuse/Terminate: Simmonds Capture Co. prioritizes a safe working environment. The photographer/videographer reserves the right to terminate a session immediately without a refund or re-shoot if the client, guests, or bystanders display threatening, abusive, illegal, or unsafe behavior.
Personal Injury/Property: Simmonds Capture Co. is not liable for any personal injury, loss, or damage to personal property occurring during an on-location session, except where caused directly by the proven negligence of the photographer/videographer.
Technical Failure: While Simmonds Capture Co. takes the utmost care with equipment, data handling, and dual-card backups, in the unlikely event of total equipment failure, technical malfunction, or loss of media beyond reasonable control where a re-shoot is impossible, liability is strictly limited to a full refund of all payments received for that specific service. Simmonds Capture Co. shall not be liable for any further financial or consequential loss.
